Malta's Nomad Residence Permit: The Income Threshold Changed, and the Tax Treatment Is Genuinely Disputed

Before building a budget around Malta's Nomad Residence Permit, know that the income threshold most casual content still cites is outdated. Residency Malta Agency's current published requirement is a minimum gross annual income of €42,000, roughly €3,500 per month, not the €32,400 figure, about €2,700 per month, that a meaningful amount of content online still repeats. That older figure applied to applicants who submitted before April 1, 2024, and it's grandfathered for them specifically, not a current baseline for new applicants.

Here's what the Nomad Residence Permit and Key Employee Initiative actually require, and a second point worth flagging clearly: sources genuinely disagree about how this permit is taxed, and that disagreement involves real money.

The Tax Treatment Question Is Genuinely Unresolved in Public Guidance

This is worth stating plainly rather than picking a side. Some current sources describe a 12-month income tax exemption on qualifying remote work income under the Nomad Residence Permit, followed by a flat 10% rate from year two onward. Other equally current, detailed sources state directly that this is inaccurate, that the permit carries no special tax regime at all, and that anyone spending 183 days or more in Malta becomes a standard Maltese tax resident subject to ordinary progressive rates up to 35% on worldwide income. Given how much this affects real financial planning, confirm your specific tax treatment with a Malta-based tax advisor before assuming either version applies to your situation, rather than relying on general online guidance, including this article, to settle it.

A Real Eligibility Trap: Where Your Income Actually Comes From

This is a specific disqualifying condition worth knowing before you apply. If you're contracted by a foreign company but the services you provide flow to that company's Maltese subsidiary, or if you directly or indirectly provide services to Malta-based companies or individuals, you're ineligible for the Nomad Residence Permit entirely. This program is built for income genuinely originating outside Malta, not for remote arrangements that route back into the Maltese economy through a subsidiary or local client relationship. Confirm your actual client or employer structure against this rule before assembling documents.

The FBI Check: Federal, and Time-Sensitive

A criminal background check is required, and for Americans that means the FBI Identity History Summary, authenticated at the federal level by the U.S. Department of State, not any state Secretary of State, the routing rule that governs this document throughout every country covered on this site. Residency Malta Agency and Maltese consulates commonly expect this document issued and apostilled within roughly 180 days of submission, so time your request against your actual filing date.

Proof of Income: The Affidavit Requirement, and No Screenshots

Private bank statements and employer income letters aren't direct apostille candidates, since they're private records rather than public documents. Where authentication is genuinely required, the correct method, covered in more depth in our general guide to authenticating financial documents, is attaching the statement or letter to a notarized affidavit sworn before a U.S. notary, creating the notarial act an apostille can then authenticate.

Separately, and this is a specific submission requirement worth knowing regardless of the authentication question: Residency Malta Agency requires an official bank statement, either an electronic version downloaded directly from your banking app or a stamped paper statement from a bank branch. Screenshots of a banking app or website are explicitly not accepted.

Family Inclusion Has a Timing Rule

All family members need to be included in your initial application. They generally cannot be added after the fact, with the specific exception of a newborn child. If you're planning to bring a spouse or children later once you're settled, confirm this timing rule with Residency Malta Agency first, since retrofitting a family member onto an already-approved application isn't how this program works.

What This Permit Doesn't Do

The Nomad Residence Permit runs for one year initially, renewable up to three times for a maximum of four years total, and renewal requires having spent at least five months in Malta during the preceding year. It does not lead toward permanent residency or citizenship. If long-term settlement is the actual goal, that runs through a separate program, the Malta Permanent Residence Programme, with its own distinct requirements.

Vital Records and the No-Translation Advantage

Birth certificates and marriage certificates, where relevant to your application or a family member's, are state documents, authenticated by the Secretary of State of the state that issued them, and only that state. Since English is an official language of Malta, standard U.S. public documents generally require no translation for submission, a genuine simplification compared to most other European destinations covered on this site. This removes the translation step, not the apostille requirement.

Where Malta Nomad Applications Go Wrong

  • Budgeting around the outdated €32,400 annual income threshold, when the current published figure is €42,000 for new applicants

  • Assuming a specific tax treatment without confirming it locally, given genuinely conflicting guidance on whether special rates apply

  • Applying while your income flows through a Maltese subsidiary or Malta-based clients, a specific disqualifying condition

  • FBI reports sent to a state office, which cannot authenticate a federal document

  • Submitting a bank statement screenshot, which Residency Malta Agency explicitly rejects

  • Trying to add a family member after the initial application, outside the newborn exception

  • Assuming this permit leads to permanent residency, when it structurally doesn't
